CMS and ONC Issue Regulations Proposing a Definition of ‘Meaningful Use’ and Setting Standards for EHR


An interim final regulation (IFR) issued by ONC sets initial standards, implementation specifications, and certification criteria for EHR technology. In a related announcement, the Centers for Medicare & Medicaid Services (CMS) issued a notice of proposed rulemaking (NPRM) that outlines provisions governing the Medicare and Medicaid EHR incentive programs, including a proposed definition for the central concept of “meaningful use” of EHR technology.  Both regulations are open to public comment.

Just buying an EMR will not qualify you for the stimulus money. Besides, if you purchase the wrong EMR, it could affect your practice’s productivity and actually costs you more in lost revenue and operating costs than the amount of stimulus money you receive. Your EMR also needs to be effectively integrated with your “Practice Management System” so that you do not disrupt your payments from the insurance company. 

There is a “Time Window” that must be met for adopting and showing “Meaningful Use” of EMR in order to qualify for the full $44,000 per physician stimulus money. The longer you delay, the less money you can receive. In addition, if you wait too long, you could be subject to “Penalties” for not adopting an EMR system.
